CAFTA has been started as scheduled, on January 1,2010. ASEAN has become China's fourth largest export market and third largest source of imports. But the sharp increase of investment behavior brings another consequence:the friction on the fields of Investment is on the increase, too. How to form a long-term investment disputes settlement mechanism, to properly solve investment disputes in the free trade area, is worth researching problem.Full text is divided into five parts.Chapter 1, "introduction". This part mainly introduced the latest development on the field of investment after the started of CAFTA. For the aim to avoid and solve investment disputes caused by the increasing investment, it is necessary to establish a unified, perfect and efficient China-ASEAN Free Trade Area Investment Disputes Settlement Mechanism.Chapter 2, " the treaties based on CAFTA investment disputes settlement rules".This chapter mainly studied the existing investment disputes settlement rules in CAFTA, and focus on CAFTA'Disputes settlement Mechanism Agreement'and 'Investment Agreement'. Finding that the investment disputes settlement rules only appeared in some relevant treaties.Without independent investment disputes settlement mechanism, it is had to keep the long development and prosperity in CAFTA.Chapter 3, " World's major disputes settlement mechanism for reference ".For the aim to build a more reasonable, perfect CAFTA investment disputes settlement mechanism, it needs to reach major investment disputes settlement mechanism in the world, seeking out the used reference, and combining with the condition of CAFTA, put forward Rational proposals.Chapter 5 "conclusion ". The establishment of investment disputes settlement mechanism would make CAFTA investment protection system perfecter, and gradually eliminate investment obstacles, promoting mutual investment between China and ASEAN countries.This will promote prosperity, stability and development between China and ASEAN countries, strengthening and deepening good-neighborly partnership of mutual trust.
