Research On The Settlement Mechanism Of International Investment Disputes From The Perspective Of The "the Belt And Road" Initiative

Since the “One Belt and One Road” Initiative was proposed 5 years ago,it has gotten innumerable great achievements.Not only have the policies and development strategies of the countries along the route been brought together,but also the pragmatic cooperation and coordinated development among countries has been promoted,which brings benefits to the people of countries along the route and even many countries in the world,brings the countries closer to each other.This is a great practice of building a human common destiny proposed by China,opening up a new world of win-win cooperation.However,opportunities co-exist in risks.There are many countries along the route of the“One Belt and One Road” Initiative.With the high or low levels of economic development,the possibility of armed rebellion and wars would be increased.Apart from attaching importance to these problems and taking precautions,we need to formulate a series of rules to regulate the possible disputes in order to ensure the further development of the “One Belt and One Road”Initiative.These disputes may involve many international economic and trade problems like finance,trade,investment,etc.This paper mainly focuses on the legal problems concerning the settlement mechanism of international investment disputes under the “Belt and Road” Initiative.As the economic exchanges among the countries along the route have become more frequent,there has been more mutual investment and disputes over the time.Therefore,the research significance is great and profound.On the basis of collecting related data,referring to a large number of relevant domestic and foreign research literature and analyzing the other research,the author studied on the current global and regional investment dispute resolution mechanism under the international community,in order to understand their operation and find out the shortcomings,summarized the reference significance for building the international investment dispute settlement mechanism in China's building the “One Belt and One Road” Initiative.This paper provides advice for the settlement mechanism from several aspects,such as following principles,mode selection,specific paths construction and so on.It is proposed to construct a set of international investment dispute settlement mechanism that is rational,effective,fair and consistent with the characteristics of the Belt and Road Initiative,so as to safeguard the construction of the “One Belt and One Road” Initiative.
