The Comparison Of Realty Registration Systems

Real property, as one of the most important property for humanbeing to survive, is closely related to people's daily life, and then, realty registration system are particularly important. This paper, mainly revolves around the regulation of the realty registration system of the Real Right Law, discusses the basic provisions in the Real Right Law. Although the Real Right Law has a exclusive chapter to introduce the realty registration system, the provisions of the realty registration system are too principle and abstract.Therefore, in this paper,we introduced the realty registration system of some typical countries, on the basis of the comparison, absorbed and drew upon fruits from the typical countries to perfect our realty registration system.In this paper, the introduction of the realty registration system is divided into three parts.The first part is "the fundamental theories of realty registration". In this part, the concept of realty registration is discussed firstly. Subsequently, we analysed the realty registration's concept, nature, function and the effect of choice. The fundamental theories of realty registration are mainly discussed in order to introduce the mode of realty registration and the other countries'realty registration.The second part is "the comparison of foreign realty registration".Firstly,This part mainly revolves around the mode of realty registration.We introduced the three typical mode——the right registration system, the contract registration system and the Tolens realty registration system. And then, we compared and analysed this three modes. Secondly, the comparisons of the details of the realty registration are discussed. Finally, we compare the differences in the different realty registration mode country in order to construct our real estate registration system.The third part is "the perfection of the China's realty registration". We elaborate this part in combination with the provisions of the realty registration in the Real Right Law. Firstly, the provisions of the realty registration system of Real Right Law are introduced.And then, proposes a perfect realty registration system's characteristic. Finally, focus should be paid on how to perfect our realty registration system. We hope that the China's Realty Registration will be legislated as soon as possible.
