Research On Law System Of China's Agricultural Insurance

As an agricultural country, agriculture is the foundation of China's national economy. However, agriculture is also the relatively weak industry, whose development faces severe natural and market risks. The various natural disasters happen frequently, which infects the development of agriculture at different degrees and causes huge economic losses. The agricultural insurance is an economic security system which intends to prevent agricultural risks and reduce agricultural economic losses. China's agricultural insurance has already gone through several decades. However, due to lack of a special legal system, its security function for preventing risks has not been effectively exploited yet. Therefore, it is the top priority to construct a corresponding legal system for agricultural insurance.Based on the current situation of China's agricultural insurance and focusing on the function each economic entity plays in the process of developing agricultural insurance business, this paper tries to construct the legal system for agricultural insurance through the method of combining semantic analysis, comparative analysis and historical analysis. During the introduction part, the situation of lack of legal system for China's agricultural insurance is presented, and then the necessity and feasibility of constructing a legal system for agricultural insurance are elaborated through introducing literature review and meaning of doing this research.The text of this paper consists of four parts. The first part discusses general theories of legal system for agricultural insurance. By means of analyzing agricultural insurance and legislation of agricultural insurance, this part summarizes the core problem that is worthy for studying in the process of constructing legal system for agricultural insurance. The second part conducts a historical analysis of the evolution of legal systems for agricultural insurance and also analyzes some problems during this evolution. The third part summarizes some advanced legislation experience that is worthy of China's reference through a comparative analysis of legal systems for agricultural insurance abroad. The fourth part clarifies the legislation goal and principle of constructing legal system for agricultural insurance in China and also puts forward the framework of agricultural insurance legislation, which may become perfect from the aspects of specific arrangements for the legal systems.
