On Lawyer Condition System

Lawyer's conditions are the basis of formulating lawyer system, whose improvement directly do influence on which kind of people become lawyer. Lawyer's condition system includes two aspects, namely, the bar examination system and the system for the lawyers to obtain the certificate. Whether having the required qualifications is the key factor of selection for lawyer's personnel, whose importance is obvious. However, in practice, its importance doesn't seem to be paid enough attention. The present situation in our country is that the selection criteria for lawyers do not keep in consistence and there is lack of management on the people who apply for the practicing certificate, which greatly hinders the development of China'lawyer system. This paper mainly analyzes the shortages of the present lawyer's condition system in China. With the comparative analysis method the author analyzes the foreign countries'lawyer system, on the base of which the author put forward a series of suggestion to perfect the lawyer's condition system in China.In addition to its introduction and preface, a total of 25,000 words, this paper mainly includes three parts, ant the details are as follows:The first part is the present situation of the lawyer's condition system in China. This section is divided into two parts:the status of obtaining lawyer qualifications and lawyer's practice certificate. The author analyzes the shortages of the referred problems from the national conditions, political conditions, business conditions and the behavior conditions.The second part is the comparison with lawyer's condition system in foreign countries. This section is also divided into two parts:the status of obtaining lawyer qualifications and lawyer's practice certificate in some developed countries such as the present regulations on the above problems in the United Kingdom, the United States, Germany and France. With comparative analysis method, the author describes the advantages of the related systems in foreign countries from the following aspects:the current training system, the existing inspection system and other relevant conditions.The third part is the analysis of how to improve the lawyer's condition system, which includes how to perfect the education system and the bar examination for lawyer qualifications. The author also puts forward some suggestion that ensures the lawyer's right, and regulates practice management in trainee time and improve the regulations about training time and inspection system of lawyer's conduct.
