Construction Of The Operation Rights System For The Lawyers In Our Country

The lawyer system is considered an important part of national democratic political system. The developmnet of the lawyer profession replesents the extent development level of civilization and legal system in a country.As the imported goods, the lawyer system in China started and developed before 1949 and was once abolished in 1949 when the People's Republic of China was founded. Guided by the socialist regime, Chinese people judge lawyers and the system as the product of the western capitalist system and cannot use western dialectics theory to eveluate the importance of lawyers role. Thus lawyers have never been respected during the early period of Chinese history and the situation did not changed even when China joined WTO. Meanwhile, the cases etc. the Huangyousong case and the Lizhuang case reflect some issues in our lawyers people. However, lawyers should not be on the beach of professional ethics and involved in irregularities, which leads to judicial corruption. Nowadays, there is hot discussion in the content of lawyer nature. As a lawyer, I would like to gvie some suggestion in this topic by choosing solid lawyer system theory and anlysing the issues in current Chinese lawyer system.Beginning with the importance of lawyer role the thesis discusses the rights of lawyers. By listing the conditions and presenting the dilemma to meet the realization of those rights, the thesis analyzes the dilemma and the "feasibility" requirement enacted by the government in order to solve the dilemma. In the same time, our own opinion on the causes of the dilemma is presented. The last part of the thesis expresses view of constructing a complete lawyers system, and proposes solutions on the issuses in bettering the lawyer rights protection system, the lawyer liablity insurance system, and lawyer living environment, which can contribute in realizing the value of lawyer profession as a whole and the development of the legal profession as well.In the 21st century, China survives in the global economic crisis. Lawyers take an important role in helping the country out of existing difficulties, assisting countries to promote the implementation of laws, improving and perfecting the laws and regulations, advising on maintaining social prosperity and stability.
