The Precautionary Principle In Marine Environmental Protection

With the progress and development of the industrial technology and social society, the new environment problem is emerging one and another, especially the problem of marine environment has been one of the environmental problems wildly concerned by the international community because of which convered a wild field, damaged in high degree and the consequences of damage can not be recovered. So a lot of countries and international organizations enavted a series of concerned legal document, the precautionary principle is developed on this situation and used to resolve the scientific uncertainty. The core concepts of the precautionary principle is that we should take preventive measures in time to protect the life and health of people and the marine environment when there is no definite evidence prove the dangerous act and material will damage people's health and environment.The paper includes five parts.The introduction introduce the development and current situation of the international environmental problem, research the causes and analysis value of the precautionary principle, and introduce kinds of major research method in the paper.Part one focus on the theoretical investigation of the precautionary principle which includes the initiation and development, the legal conception and status of the problem;Part two focus on the legal practice of the precautionary principle which includes the settlement of the practical problems and the relevant pearls and pitfalls;Part three focus on the prelationship between the recautionary principle and Chinese marine environmental protection which includes the main problems and the legeistation situation of Chinese marine environmental protection, the embodiment of the problem in Chinese legeistation and how to complete it.The conclusion is the summary of the study situation of the precautionary principle, and it is a coming into being customary principle of international law which could resolve the complex marine environmental problems, we should introduce it based on the China's actual conditions to protect marine environment more effectly.
