Research On Criminal Procedure Of Rapid Decision

In recent years, with the rapid development of the economy, the crime rates is becoming increased significantly and the case piles up seriously. In order to effectively alleviate the pressure of justice, every country has set a wide range of criminal procedure of rapid decision. In this paper, we are based on our national conditions, by the study of other country's criminal procedure of rapid decision process to build a criminal procedure of rapid decision.The whole thesis can be divided into four parts:Chapter one is the introduction of the criminal procedure of rapid decision, explain what the meaning of the criminal procedure of rapid decision and analysis the value of its existence. The criminal procedure of rapid decision is a process as compared to general criminal procedure, mainly referring to special procedures which through simplified some steps of the general criminal procedure make the case to a speedy trial in the trial of the minor criminal cases.Chapter two discusses the primary kinds and development summary of foreign criminal procedure of rapid decision. This part introduces the common law and civil law countries of the legislative provisions and judicial practices-specifically including the United States, Germany, Japan and other countries, illustrate diversity criminal procedure of rapid decision is the world's program development trend of procedural legislation.Chapter three is current situation of the criminal procedure of rapid decision in China. This part introduces the existing criminal procedure of rapid decision-Summary procedure and Summary trial mode of ordinary Procedure.For specifically; the paper introduces the Summary of the legislation of criminal history, current status and application of legislative provisions and the existing shortcomings, and Simplified Procedure of the existing content and defects.Chapter four is the construction for diversified criminal procedure of rapid decision in China. Mainly introduces the necessity for building diversified criminal procedure of rapid decision, the basic principles to be followed in the process and the concrete construction for diversification criminal procedure of rapid decision.
