Carbon dioxide emissions, as the representative of the energy consumption and pollution discharge behavior and the close relationship between human economic activity is a problem that a modern industrial country must face. Carbon emissions lay significant impact on the environment which has caused deep concern around the world.To the international economy, trade and environment relationship is a focus. To curb the excessive growth of global carbon emissions in international community, a general agreement is sharply needed. Some countries have taken a series of lead in greenhouse gas emissions to internalize the costs to enhance intervention in economic activities on the environment.The introduction of environmental factors in trade has been existing for a long time, but as a legal design, the framework for the impact of world trade is minimal.In accordance with the "Kyoto Protocol"provisions and its Annex I, countries are obliged to implement mandatory emission reduction policy. The burden of non-Annex I Parties are not mandatory to take emission reduction obligations. Therefore, countries which are taking emission reduction measures, compared to non-Annex I Parties are bound to have higher production costs. Artificially increase their products in prices, thereby affecting the international competitiveness of related industries, Annex I countries to assuming the "loss of competitiveness." This allows countries which aretaking emission reduction measures use trade measures to regain competitiveness.Meanwhile, in the performance of the "Kyoto Protocol"Some high energy consumption industries in the Annex I Parties shifted to non-Annex I Parties or countries.That is international "carbon leakage."Market failures caused by global scale and individual countries calls for WTO trade structure to reconstruct.The market economy is the commodity economy, free trade is the philosophical foundation of WTO and economic globalization.Thus, in the perspective of WTO mechanisms to analyze the relationship between trade and the environment is more reasonable. The first part shows the background of global carbon and carbon tariffs,outlining the duties of carbon in the recent economic tide.The second part studies the legal meanings of carbon tariff in order to explore the rules of international trade measures for environmental adaptability with WTO rules,pointing out the fuzzy area between them and trying to clarify the vague points.The third part, China as a vital participant will participate in the revision of the rules of the game,How to win in this game?From the perspective of the global legal system I will propose some low-carbon suggestions.
