On The Act Of Bribery By Using The Influence In Criminal Law

The act of bribery by using the influence is a new concept in china's criminal law, the theory of it become the key research in our criminal theory at present. This behavior has become one of the battle against bribes crime in our criminal law. As accurate and comprehensive grasp this behavior, it needs comprehensive research and described.Based on the theory of criminal law and combined with judicial practice, this paper emphatically from three aspects to research and analysis of the act of bribery by using the influence. First through the analysis of the texture concept of it, the provisions of the influence behavior in the Domestic law,International law and China's Criminal law educational world , to define it clearly. Second to analysis the structure of using the influence bribery from it's pattern and object, clearly that it is through direct way and has essence significance but no authority, then give the request,accept bribes and the object of it a definite definition. At the last to distinguish the different between the act of bribery by using the influence and the act of common bribery,introduce bribery,mediation bribery from the different of basic crime, distinguish those behaviors clearly is very important to cognizance the act of bribery by using the influence in judicial practice.
