Market economy develops at full speed during the past years in our country, only be hampered in history and real cause, the law regulated is comparatively weak, thereby, market economy displays heavily damaged ill—condition appearance. False advertisement being widespread and uncurbed is one of behaviors. The false advertisement is the one whose content is false, Or which make the false propaganda leading easily to misunderstanding, False advertisement being in flood not only has endangered the free competition order of market economy, but also the prosperity and development of advertisement industry, For various reasons, practical implementation of existing legal attribution of false advertising is not enough,Therefore, the false advertising liability need to be resolved,Purpose of this study is to improve the legal system of advertising, so that legislation is reasonably practicable, the law, and thus an appropriate scientific approach to combating false advertising, the advertising market to maintain a healthy and orderly environment for competition, consumer confidence to the consumers. This study covers the basic problem of false advertisement, and improves the status of proposed legislation. In this paper, theoretical, empirical and comparative methods are discussed in the argument. The innovation of this paper is to compare the case of extraterritorial legislation, the legislative situation in our country, improve our legislative proposals put forward.
