| Overseas investment insurance is a system that the country which export the capital executes to remedy non-commercial risk after it happens. By this means, the exporter wants to protect the investment in other countries. Overseas investment insurance system was initiated in 1948 in America. For its well effect, overseas investment insurance was adopted by many main capital output countries of the world. With the rapid development of the China's economy, more and more domestic companies invest abroad. However, overseas investment legislation is extremely deficient, especially overseas investment insurance system. It is more important for us to build and Perfect legislation about overseas investment in order to protect our overseas investment. Therefore, on the basis of the comparative study on the insurance scheme of the overseas investment, this thesis makes a preliminary research on constructing and perfecting the insurance scheme of our country, overseas investment.The text consists of four parts and is organized as follows:The first part introduces the general overview of overseas investment insurance system, including definition, legal features, nature, role and significance, then introduced the system of overseas investment insurance history, in order to have a complete understanding for overseas investment insurance system.The second part introduces some materials related with the foreign investment insurance system such as United States'Japan's and Germany's foreign investment insurance law system as well as MIGA term which related to the foreign investment insurance system, then makes a comprehensive comparison and analysis on the overseas investment insurance scheme of the above-mentioned countries from the comparative angle in the hope of providing some beneficial references to constructing our country's the overseas investment insurance scheme.The third part introduces the development of our country's overseas investment insurance. After introduces China's overseas investment insurance status, existing problems, then analysis of China's overseas investment insurance system to establish the necessity, possibility, the author suggests that it's necessary to establish the oversea investment insurance system.The last part of the thesis put forward to related suggestion for constituting the 1aw of investment insurance scheme in our country. This part focus on overseas investment insurance system in the mode selection, the insurer's one-tier system with the dual system, qualified investors and qualified overseas, overseas investment and other issues described. Meanwhile, on the basis of comparative analysis, to construct the system of overseas investment insurance issues in the design of the corresponding concept. |
