As the pillar industry of our country, the real estate industry is the important component part of the national economy, which relates to the national policy and the people's livelihood. Most industries all have the close contact with it in the national economy. The real estate price is the foundation signal which reflects supplying and demanding relations of the real estate market and installing resources. At the same time it is the important component part of the national economy price system. In recent years, our country real estate industry develops fast and fierce, which pulls inside need progressively and promotes national economy development to the utmost, but it lacks experience of macroscopic control and is short of the preparation of related systems, so the real estate market inevitably conceals many crises of the behind market prosperous back. These crises concentrate on non-reasonableness rising of the real estate price, which is harmful to setting up harmonious society and the stability of the society. In order to repress the increase of the real estate price, the government has adopted a series of powerful measures of macroscopic control since 2004, but some tough problems have not been resolved thoroughly all the way. The real estate price of many cities still goes up quickly and the contradiction of the housing supply structure which is not reasonable is also very outstanding. The effect of real estate price control is very tiny which has already caused extensive concern of experts in this industry. Writings about the real estate price control flow out largely; however, there are lots of different viewpoints. Taking a wide view of these researches, the writer find that basic consistent on the direction of the real estate price control are the profits and the real estate price.The writer of this essay closely concerns the legalization and rationality of the price control measures carried by the government. On the basis of the analysis on real estate price control, drawing the advanced experience about the real estate price control from the Europe and America nations, the writer analyses emphatically the policies about the real estate price control of our country, the existent problems and counter measures. The policies of the real estate price should carry on under the law and pursue the good results. For this purpose, the government should combine national conditions of our country and establish long effect mechanism about the real estate price control when adjusting and controlling the building price. This mechanism should combine various law systems of the finance, revenue from tax, land, the society guarantee etc together to realize the dream of everyone having his house and promote the health and fast development of the real estate market. Certainly, the writer tries to make commentary analysis of the real estate price control and expects to get the profound thinking as well as enlightenment, which is helpful to provide the new thinking way possessing law meaning for perfecting real estate price control of our country,In this article, we have utilized many research methods, such as, current politics analysis, value analysis, current politics economic analysis, graph analysis and comparison research and so on. The text is divided into six parts totally. The first part is preface, it is composed of four aspects, which are background and significance, studies and research of domestic and foreign, methods and innovation, Brings the questions and analyses the necessity and significance of the thesis The second part is the general theory of the real estate price control law system. From the related concepts of the real estate price system, the writer introduces the real estate, the real estate price, the real estate price control and analyzes basic characteristic of the real estate price control law system, price control law relation subject and the means of price control; The third part discusses the theory foundation of the law system of the real estate price control, among which includes the economics theory foundations and the science of law theory foundations and further expounds the existent value and necessity of the real estate price control; The fourth part introduces the comparison of foreign real estate price regulation law system, mainly including finance, revenue from tax, transfer the possession of houses, land and housings guarantees etc. systems of U.S.A, England, Japan, Singapore etc. By the comparison, we can draw the their experience of price adjusting and controlling to help our country indicate the direction of real estate price; The fifth part, from the finance, revenue from tax, land and housing guarantee systems etc., the writer combines the theory with our present situation, clarifies the policies and the existent problems in the real estate price control of our country, and finally finishes this paper with the discussion of measures on perfecting the real estate price control of our country. The last part is conclusion, in order to control real estate prices to irrational rise, the government should comprehensive use of finance, taxation, land, administration and social security control measures and so on, and combine them together from different angles, bring into play their own unique function, establish harmony and organic real estate price control system.
