On The Diversified Settlement Mechanism Of The Rural Land Contracting Dispute

In recent years, with the sharp rise in the number of land disputes, land disputes settlement mechanism of diversification has become even more intensive. Exploring the diversity of rural land contracting dispute settlement mechanism, not only meets the national trend solve the problem in rural areas, but also effectively protects the land rights of farmers, enhances the rural development and even ensures the social stability goals of the socialist rule of law. This paper starting from the diversity of rural land contracting dispute settlement mechanism, puts forward problems of China's diversification of rural land contracting dispute settlement mechanism, studies the selective practice the villagers in rural land contracting dispute settlement mechanism, and proposes the recommendations.With approximately 31,000 words in total, this article is composed of three chapters besides introduction and conclusion.The first chapter: the simple introduction of the diversity of rural land contracting dispute settlement mechanism. This part firstly briefly describes the contract management of rural land disputes in the form of features and performance, and then lists the diversification of the rural land contracting dispute settlement mechanism in legislative history, and finally puts forward the meaning of the rural land contracting dispute settlement mechanism.The second chapter: the analysis of the practice of the diversity of rural land contracting dispute settlement mechanism in our country. This part firstly analyses the present legislation of the diversity of rural land contracting dispute settlement mechanism, proposing the progress and shortcomings of the diversity of rural land contracting dispute settlement mechanism, then does some practical analysis of the diversity of rural land contracting dispute settlement mechanism, through the research data which show the farmer's choice in the diversity of rural land contracting dispute settlement mechanism.The third chapter: perfection of the diversity of rural land contracting dispute settlement mechanism. Although the country has given full attention to rural land disputes, and has promulgated a special law, however, diversification of rural land contracting dispute settlement mechanism still has some deficiencies. In view of the question which exists in the second part, this part proposes a series of suggestions to improve the diversity of rural land contracting dispute settlement mechanism in our country, for example: we should strengthen the supervision of the Arbitration Commission, strengthen mediation's role in resolving disputes in the rural land contracting, strengthen the reasonable convergence of the arbitration and litigation and so on, with the hope to do some effort to perfect the diversity of rural land contracting dispute settlement mechanism.
