As the development of the world, people pay more attention to high level expense. More and more people choose to travel as a way to have a rest. The tourism which is called sunrise industry is developing rapidly. But along with the development of the tourism, some unharmonious matters appear. Matters which violate the rights and interests of tourism consumers happen from to time. Our country is building socialist legal system. Tourism legislation is lagging behind. It can't protect the rights and interests of tourism effectively. So, it's necessary to strengthen the legislation of the tourism and make the protection of the rights and interests of tourism consumers perfect.This paper introduces status of the protection of the rights and interests of tourism both home and abroad. Some measures which make the protection of the rights and interests of tourism consumers perfect are also listed. The paper intends to make some contribution to the protection of the rights and interests of tourism consumers.There are four parts in this paper.The first part summarizes the content of the protection of the rights and interests of tourism consumers. The boundary and the content of the rights and interests of tourism consumers are also introduced. The tourism consumers are special consumers. It's necessary to make special stipulation.The second part analyzes the necessity to protect the rights and interests of tourism consumers from the angle of practice and theory. There are many disputes in tourism nowadays. Some travel agencies make false advertisement to cheat tourism consumers. There are many reasons for the disputes and the most important one is that tourism consumers are weaker than the tourism organizers. Reason of the weak position is analyzed. The legal system of the protection of the rights and interests of tourism consumers is not perfect. There is no utilized law and the relative law is not perfect. Some tourism consumers whose rights were violated can not get enough payment. The travelling contract is unnamed contract and the terms of the contracts are standard terms. The tourism organizers often use the standard terms to violate the rights of the tourism consumers. The significance of the protection of the rights of the tourism consumers is also analyzed.The third part analyzes the legal system of the developed countries and the point that we can refer. The fourth part states the measures to make the protection of the rights of the tourism consumers perfect. According to the legal system both home and abroad, this part introduces four measures. It includes: speed up the legislation, strengthen the adjustment of the relationship between the tourism consumers and the travelling agency, establish travelling court and improve the compensation of the spirit damage. A legal system which based on the travelling law, the separate law, and the relative law should be built. The travelling contract should be named. Only by these measures, the rights of the tourism consumers can be protected more effectively.
