With the advocation of people first and the introduction of humanistic care, today as individual rights are emphasized contiously and universally, patients are becoming more aware of their rights in the patient and doctor relationship.it is without doubt that people are giving ever more attention to patients' rights. The status announced by Chinese Center for Disease Control and Preventio in 2009 showed that the number of each type of mental diseases in our country is over 100 million。Moreover,there is some investigative statistics show that the number of psychopath in our country is over 16 million。As is known to all, China's current not unified mental health law of hospitalized psychiatric patients with rights often neglect even being infringed upon.。This article begins with the study of patients' rights and the protection of their rights in the patient-and-doctor relationship, The first part is briefing introduction on the basic knowledge about mental diseases and compulsory admittance andt reament. The second part is stressing on researching the rights of psychopaths who receive compulsory admittance and treatment and put forward the protection methods on how to protect their rights during the process of compulsory admittance and treatment, continuous treatment and their corresponding rights after returning back to the society. The third part is Dating back to the cognitive process of enforcing remediation about psychiatric patients in abroad and our country ignored the background of the legislation on it in the early years. The fourth part is analysing the patients' right protection in compulsory admitting and treating measure of our country. Including, The protection of the rights of those being forced to accept diagnoses;The patient informed consent right in treatment; The liberty of corresponding and the protection of the rights of leaving hospital; Also will be talking about after patients return to the society, protection of his rights of labour and employment. The fifth part is put forward the relative measures which can help promote the legislation improvement on the basis of the existing problems listed before。So as to get inspiration from it for establishing "Mental health law" in the future.
