Research On The Social Problems And Countermeasures In Urban Demolition

With the rapid development of urbanization, urban demolition also presents the fast growth tendency. And in recent years violence relocates, violence against demolition attracted the public attention to city demolition, and academia have been constantly exploring and analyzing the problems caused and its countermeasures. Although a significant number of researches have been done to analyze the advantages of doing it, it didn't differentiate the public demolition and commercial demolition. Moreover, the social problems caused by urban demolition have seldom been studied systematically.As social problems in urban demolition have been taken as the object of the research, this paper, based on differentiating the types of urban demolition, will explore the interest pursuit and action logic of relevant subjects involved in the urban demolition. Therefore, it will explain the reasons for the social problems. A basic feature of this study is that the analysis has been undertaken around the occurrence of social problems and that the solutions have been proposed to the social problems.This paper argues that the analysis should be done on the precondition of differentiating public demolition and commercial demolition. In commercial city demolition, government, demolition developers and the dismantled have complex relationship of interests; And the public demolition mainly concerns the dismantled and government. In city demolition, the government who is representative of public interests as well as their own interests appeals to their own interests with the public power. Developers are in pursuit of the maximization of profit and the combination of administrative power and reducing their costs become effective means; the dismantled have the preference of maximizing personal interests on the basis of the maintenance of legitimate interestsThe basic reason for those Social concerns of pulling down in cities, such as extensive letters and visits from the masses, colony incident, the incident of violence, malignant incident,etc., is that the interests relation was not coordinated. The lack of complete laws and regulations available, the unclear function of the government, and the defectiveness of the system mechanism altogether induce these concerns. Aiming at preventing from and managing the social concern of the city while pulling down, the most basic starting point should be handling the relation among public interests, commercial interest, and personal interests, as well as coordinating the contradiction among the government, developer, and people whose houses are pulled down, on the basis of defining public interests. This demands us to set up and improve special legal norm system, perfect the system of pulling down in the city, and orient the function of the urban government accurately.
