In recent years, due to international trade booming, that conflict of laws for intellectual property in international trade has occurred can not be ignored. But now, conflict of laws for intellectual property in international trade is not concerned. Conflict of laws for intellectual property in international trade is not conducive to security and stability. Therefore, to the healthy development of international trade, also to the protection of intellectual property rights, resolution of conflict of laws for intellectual property in international trade has became imperative. This paper selects several kinds of it to find their solutions through analyzing. The ultimate goal is that think of protection of intellectual property rights from the angle of solution to the conflict of laws.Paper is divided into four parts.Part one describes the causes and concept of conflict of laws, analyzes the relationship between conflict of laws for intellectual property and regional intellectual property.Part two clears why paper could choose the conflict of laws for intellectual property in international trade as research objects. Then this section will be made simple classification of conflict of laws for intellectual property in international trade, and find different solution for them.Part three is on the legal conflict of infringement and crime for intellectual property in international trade. The type of conflict is a special type of legal conflicts for intellectual property in international trade. Firstly, this section will prove its theoretical and fact basis. Secondly, this section will discuss its solution on the basis of domestic law, and then find its solution in international trade. Finally, this section will discuss how enterprises could try to prevent legal risks from the conflict of intellectual property law, and make reasonable suggestions.Part four is conclusion. This section will conclude all ideas and attribute to extended conclusion: promoting uniform legislation between international and each district of law, in order to avoid the generation of legal conflict for intellectual property from the source, to protect intellectual property rights better.Looking at the full paper, each part links closely. The author put forward their own views for the settlement of problem by discussing the full text. Not only does author hope to offer reference for the solution of legal conflict of intellectual property in international trade in the future, but also want to protect intellectual property rights usefully.
