On The Efficency And Systematic Completion Of People's Mediation System

Social stabilization is the priority as we are building the socialism harmonious society. Civil conflicts exist widely in market-oriented economic system. We are in need of dispute solution system which costs less and is effective to build socialism harmonious society. Among all the civil dispute solution systems the people's mediation system is always valued highly as it existed longer and its function scope is wider and the its number of conflict which is solved by all sorts of solution system is higher than any other dispute solution systems. People's mediation system works efficiently but as there are some problems about the people's mediation accord, its function has been affected by the problems mentioned above. In order to improve its function of solving civil conflicts many districts in China in doing empirical quest. On this background Supreme Court has issued some regulations and the Standing Committee of the People's Congress has issued people's mediation law. All of these have something to do with the people's mediation accord. The purpose of these is to make the people's mediation system work more effective. People's mediation accord is the core issue of the people's mediation system. The people's mediation system will be badly affected if there are problems about the people's mediation accord. The regulations concerning the people's mediation accord are newly established so they are not sophisticated enough to cope with all the problems occurred in reality and they are not strong enough to protect all kind of rights of people. As a result, when people are involved in civil conflict they always have a second thought when it comes to using the people's mediation system. This situation has now seriously affected the function of the people's mediation system. The author chose the people's mediation accord to be the object of this paper so people can resort to the people's mediation system with no strings attached and the system can protect people's rights better and the problems about the people's mediation accord can be solved and the people's mediation system can work smoothly. This paper introduced the concept of the people's mediation accord on the basis of discussion of the function scope of the people's mediation system then analyzed the nature of this system. This paper denied the nature definition of the people's mediation accord as contract. After analyzed the characteristics and functions of the people's mediation system this paper illustrated the significance of the system and offered some suggestions on how to complete it. I hope these suggestions will make the system more effective.
