Research On The Reform Of The People's Mediation Committee Under The Background Of Government Purchasing Service

Nowadays,the object of the government purchase has been expanded from the tangible infrastructure construction to the invisible public service field.The efficient use of the government purchase behavior to the public resources and the stable administrative contract relations have guaranteed the orderly production and supply of all kinds of public products.With a series of central systems as the policy support,the theory of public product theory,citizen autonomy theory,social governance theory and non-litigation dispute resolution theory as the theoretical foundation,the people's mediation service has been included in the the government purchase.On the basis of clarifying the connotation of public service and government purchase of public services,It can clarify the public service attribute of the people's mediation service and define the basic content of the government's purchase of people's mediation service.Combining with the policy contents of our government procurement law system,based on the current practice,the basic practical experience of Chinese government purchasing mediation service can be summarized into three categories:individual purchase,organization purchase and association purchase.By comparing three kinds of people's mediation committee in practice to try,can be found in the practice of different degree of autonomy of the people's conciliation committee,organization framework,perfect degree,efficiency of dispute resolution,degree of coverage area have obvious difference.Through the comparison of the people's mediation committee in different practices,the people's mediation committee and the government purchase service work haven't work in a harmony,and there are still many problems.The problem is mainly reflected in the absence of the people's mediation committee in government purchasing,in some practice,it is not effective to undertake the purchase of government.The people's mediation committee has not fully implemented the network construction.The incomplete network system of people's mediation organization is still the mainstream.The proportion and structure of the inside of the people's mediation committee is not reasonable,neither can it well adapt to to the complex,complicated and specialized problems of the current social disputes,nor can it rely on the background of government purchasing service to realize effective internal governance.In addition,the people's mediation committee has failed to achieve self-government development through the government purchase model,and there are still problems such as insufficient capacity and insufficient cultivation in the realization of autonomy.In view of this,it's necessary to carry out the internal and external reform of the people's mediation committee.The specific proposals are as follows:to rationally plan and promote the governance of the internal mechanism of the people's mediation committee,to optimize the internal structure of the internal organization according to the different practice forms,to retain the new institutions,and at the same time,we should improve the proportion adjustment,the management of the specialization and institution,and establish an autonomy mechanism.The central document should stipulate that the people's mediation committee is qualified to undertaking the service,and clarify the regional differences and stage differences of the government's purchase of people's mediation services.For different regions and different stages,we should design the working mode and development path of the people's mediation committee.In addition,it is also necessary to establish positive interaction with other social entities,absorb experience and improve the network structure of people's mediation.
