On The Protection Of The Privacy Of The Investigation Stage

Privacy is an important civil rights.With modern social civilization development and informatization, by a growing threaten to privacy, the citizens of privacy protection consciousness is also increasing, many countries have paid a lot mentions to the protection of privacy. In China, even though legislation on privacy have protected privacy from different angles more or less, not as an independent right to protected.And citizens in our country generally have weak awareness of privacy protection. Confirming and protectiing privacy is the symbol of development of human civilization The law of protection of privacy is not only beneficial to stable social order, but also to protect and expand citizens' freedom and to strengthen the protection of private rights of citizens, so the protection of privacy have great significance and is urgently needed.Privacy invasion is the most serious phenomenon in the criminal investigation procedure.This paper is mainly revolves to privacy protection in investigation procedure. Structurally, the first part of this text is to summarized the concept of privacy;The second part is mainly aimed at discussing the necessity of privacy in the investigation procedure namely to discuss the the important position of privacy in the investigation procedure in criminal suit;The third part is to discuss the privacy protection behavior in the investigation for specific elaboration; the last part to put forward some improving suggestions about privacy protection in investigation procedure namely that enhancing the investigator's consciousness on privacy protection, establishing Writ principles and Exclusionary Rule, strengthening supervision, to protect citizens' privacy together etc.The novel in this paper is combinding Criminal procedure law Economic law with Law sociology to discuss the privacy protection in the investigation procedure, and finally puts forward some improvement Suggestions.
