Fund "rat" Crime

At beginning, this paper will give a specific definition of the rat trading from the essence of this behavior.Then, the author will discuss the reasons for convicting this behavior into criminal behavior from the micro and macro aspects. Comparing the "insider trading" with "breach of trust" from the different point of view, the author approve using the accusation of "make use of the convert information to exchange".then the main part make a detailed analysis of the constitution of this crime with the case. In addition, this paper also discusses the problem of application in order to guild the judicial practice. Finally, it discusses the criminal responsibility of this crime, finding that the sitting of the pecuniary penalty and punishment against the freedom exist some problems. According to these problems, the author suggests making use of the punishment against competence to publish this behavior.
