Organ transplantation is the sign of the world's high-tech medicine, it has brought a revolutionary change in the medical field. With the rapid development of the surgery, immunosuppressive drugs, organ preservation and cell separation techniques and immunological basis of transplantation, organ transplantation has become an effective treatment of organ failure and brought the new dawn to many terminally ill patients. However, Science and technology is a double-edged sword, no exception even for organ transplantation.During the growing process, organ transplantation also have a series of legal problems. These issues have became increasingly prominent, if not addressed promptly and effectively, it will hinder the development of medicine and brought the society instability if not addressed promptly and effectively with increasingly prominent. Organ transplantation not only needs the guidance from the medical theory, but also in need of legal norms. It depends on that there is no perfect legal system to regulate the field of organ transplantation, resulting in the overall level of the cause of organ transplantation in China is still low. Thus, it is essential to thoroughly investigate the laws and regulations related to organ transplantation, in order to promote the rapid development of China's organ transplant.This paper introduces the concept of organ and organ transplantation, classification, characteristics, and the development of domestic and international status of the human organ transplant at first; The second part of the legal principles in the analysis of organ transplantation at home and abroad on the basis of the status of a legislative organ transplant assessment, to find The legislation of organ transplant problems; third part of the legislation for organ transplantation in China's current problems, make sound recommendations, including legislative mode selection, the specific legislative measures and so on. For the current shortcomings in the law, Human organ transplants in China should answer readily and based on the status and conditions of organ transplantation。Meanwhile , we should improve positively the legal system of human organ transplantation based on the May 1, 2007 introduction of the "Human Organ Transplant Ordinance " . Only in this way we can improve the status of organ transplantation, regulate human organ transplants better ,guarantee the quality of medicine, protect the health of human, safeguard the legitimate rights and interests of citizens.
