Following the development of the network techniques and promotion of the network's socialization, network not only provides a multiracial public speaking platform to the society, but also promotes the advancement of social democracy. And then the network becomes the"forth media"after newspaper, broadcast and television. At the same time, we also must find that, though the net has a lot of characters such as open, cross-region, virtuality and timeliness, it make the civil rights weaker in the cyber world, and the reputation right is one of them. In our country,network reputation infringement is a new phenomenon, and also a new problem, emerging in the process of network culture construction and management.If it is not properly solved,not only brings terrible loss to the law and order,but also largely destroyes the freedom of expression and the other civil rights.Under the current social situation, the paper will be on the basis of communication theory, and researching in a legal perspective to protect the civil rights,on the other hand, the aim is to better protect the rights of public freedom of expression.Throughout the construction of the paper,the concept of the freedom of expression and reputation infringement in the network transmission is primarily defined and expounded,then analyzing the reasons of conflicts between them .After that,based on the concrete analysis of main ways,constitutive requirements,responsibilities and accountabilities, contradicts ,I make further research in the balance of expression freedom and reputation protection in the network.Finally,it provides some feasible reference suggestions.We must take measures to improve legislation, strengthen self-discipline mechanism construction .In addition,I expect that it can be benefitted for the reputation infringement in the network communication in our country.
