Changes In Rural Land Protection Of Land Rights Of Farmers

In China, the land is the foundation of rural social economic life, is the most important production material of the farmers, and the important sources to the farmers'social security at present, maintenance land rights is the most important issue to protect farmers' basic rights.The rural land system has evolved from land reform to establish people's communes to carry out household contract responsibility system three stages since the founding of new China. After several changes, the rural land system insists on the mode that farmers have the contract management right to rural collective land at present. Farmers have the contract management right, including right to possess, utilize, seek profits and dispose to a certain extent.But China's rural land issues has been influenced by the historical background, economic system and the rural legal environment, in a certain period of time, we may have a certain gap between the ideal and the reality. People are now showing more and more concern about how to protect farmers land rights and interests at the present stage, there are also many problems need to formulate special laws and regulations, to revise the current law, etc. Based on China's national conditions, to investigate and evaluate the changes in the history of the rural land system since the founding of new China in this paper, and comb the current land rights infringement of farmers and analyse the causes, have comparative study for our current law on the relevant regulations and academic. Based on this, put forward the countermeasures and Suggestions to protect the farmers' land rights and interests, the research in the above is sure to improve legal system of rural land, and hope it can contribute to the rural development a little bit.
