The Comparative Study Of House Lease System Between China And Germany

At present our country appear such phenomenon including unbearable prices of residential, panic purchase of the houses by the public so that making the Lease system become more and more widely used legal system. But our current house lease system is not perfect and comprehensive and the provided law still has the loophole. These series problems lead to lease disputes and social contradictions occurred frequently. In Germany, by contrast, the perfect lease system makes people prefer renting house to buying one in their lifetime. Thus, through the introduction, comparison and analysis of house lease system between China and German, tries to rectify and reform the concept of Germanic legal value and the system to enrich our house lease system and housing protection system.Firstly, the author introduces the historical evolution of house lease system between China and Germany in order to understand the historical evolution and development of this system in two countries. Then this paper summarizes and introduces the general system and special system of house lease legal system between two countries to interpret the existing systems. Through the comparison of house lease system of two countries, the author summarizes the differences between two countries'systems and analyzes the advantages and disadvantages of the two systems and the formed reasons. At last, the paper points out the shortage of our house lease system. Through reasonably referring to the advanced experience of the German lease system, the author proposes the legislative and institutional suggestions about lease system and strives to consummate our house lease system and construct housing guarantee system.The author hopes this paper can lead us to make full attention to house lease system and housing guarantee system of our country, and to find problems and solve problems in practice.
