Research On The Laws And Regulations Of Green Securities In China

In recent years, the environmental situation is severe in many countries, and the polluted environment is a typical exterior diseconomy question. Law methods which make economy activities exterior diseconomy interior include direct regulatory measures (administration order control measures) and indirect regulatory measures (environment economic measures). In environmental regulation field, administrative measures have many limitations, and environmental problems become more and more serious and difficult to control, so it is a common consensus for every country that environmental economic measures can advance environmental protection. In the capital market, green finance, environmental protection at the core and aims to appropriately deal with the relationship between finances and sustainable development, has being a tendency. Green security, a kind of green finance, is important for listed companies to intensify their efforts to control and treat pollution, conserve resources, protect ecological environment, control illegal dredge activities. Moreover, it can help the investors make "green invest" decision. It is being accepted by more and more people.Green security is the third environmental economic measure after green credit and green insurance. It takes on the heavy responsibilities that scarce resources are configured on industries which are favorable for social development. And green security inspects the environment problems when listed companies seek financing by listing on the stock market firstly and refinance, and this measure is important in many field, such as energy conservation, emission abatement, industrial innovation, environmental protection, etc. This thesis starts from Zijin Mining's pollution accident, analyzes green security's basic theories and problems in practice in China, furthermore, it proposes some pointed suggestions based on the present existing legal system of our country. This thesis includes three main parts. The first part is about the basic theories of green security which explain its meaning, functions and significance. The second part brings forward the problems we meet in operation. Implement of green security is important for environmental protection, however, because of lacking of corresponding legal protection and support measures, it has many problems in the establishment and implementation of green security. The third part proposes some strategies to deal with these problems. Based on these problems existed in the implementation of green security system and China's basic national conditions, we should learn from the advanced experience of the United States, strengthen the building of green security system vigorously from the legislation, safeguard the implementation of the green security system from the law enforcement, eliminate local protectionism, so as to create a good environment for the implementation of green security.
