Research On Several Problems On Negligent Offense In Environmental Regulation

With the population expansion and the process of further accelerated industrialization, ecological environment disruption question becoming a social problem seriously.And, the ecological environment is the main reason for the sharp deterioration, is due to some environmental supervisors not strict to enforce the law and regulation slack, what are leading to the phenomenon of ecological environment destruction long-standing, further more they intensified the deterioration of ecological environment.Therefore, strengthen environmental supervision and enhance the supervision on environment law are important and effective to environmental pollution accidents.This thesis is based on the dialectical materialist perspective to extract from environmental regulatory breach of duty crime prevention and environmental protection angle to environmental regulatory dereliction of object, subject, legal sentence and standards for such problems, and put forward the author's views and opinions. During the research, both means of environment law basic knowledge, and adopted the punishment law, the relevant theory of the problems concerned have tried to adopt economic theory analysis. The article is divided into six parts,here are they:introduce China environmental regulatory dereliction of legislative history, analyze the negligence of the crime of environmental regulatory structure, analyzes the environmental regulatory dereliction of legal sentence, analyze the environmental regulatory dereliction of sin and bribery several crimes, analyze the environmental regulatory dereliction of determination standards and analyzes the environmental monitoring over sin and other relevant charges negligence the boundary issue.
