Research On Light Punishment Of The Crime Of Dereliction Of Duty

With the continuous economic and social development, social civilization and the constant increase in the legal system has also made remarkable achievements. However, no sound legal system, without the matching mechanism, its implementation will be the final result is not perfect, but there is dereliction of duty problems and shortcomings in this regard. Dereliction of duty is a serious malversation in China. According to statistics, the average economic loss caused by negligence cases of corruption and bribery cases is almost equal to 17 times the number of casualties is currently living in various crimes in the first. We must be severely punished according to law, which is consistent with the principle of legality of criminal law and to adapt the principles of criminal culpability. But in recent years, light punishment of the crime of dereliction of duty became more and more serious. The characteristic is more pardon and probation and less real criminal sentence. Sentencing is generally low. This issue has caused wide public concern, CaoJianmin, the principal of the Supreme People's Procuratorate, point that Procurator organs should intensify the punishment effect of dereliction of duty. If the light punishment occurs, we must protest legally. Under the stern situation of combat corruption and build a clean government, seeking scientifically penalty policy becomes imperative. We must analyze the characteristics of the phenomenon of light punishment and its causes in-depth. Based on the judicial doctrine and some related practices of Heze city, this paper analyzes the status and cause of light punishment for dereliction of duty, and brings forward the corresponding countermeasures.This paper includes four parts. The first part introduces the concept of the light punishment and its behaviors in judicial practices. Taking Heze city as an example,the second part introduces some represtation of light punishment in dereliction of duty and its harmfulness; The third part anlyses the cause of light punishment in dereliction of duty; The last part brings forward the corresponding countermeasures about light punishment.
