In order to maintain normal production, generally the employer will establish internal rules and regulations. To ensure the workers comply with rules and regulations, the employer generally establish matters which to be punished as to the penal system take effect. On the one hand disciplinary system plays an active role in maintaining the production and order. On the other hand, punishment inevitably decreases the worker's rights, and liable to be abused by employer in practice. The problem of legal provisions about disciplinary power in china's current legal system is that the old law has repealed, but the new law doesn't legislate, authorizing large but small constraints, lack of discipline exercised rules. It's far-reaching significance to redesign disciplinary system under the existing legal framework to ensure the disciplinary measure is legitimacy, effective and reasonable, to protect the rights of workers against the abuse of disciplinary power. From the basic theory of disciplinary, learn about the theory of disciplinary power, the enactment of legislation and judicial practice in other countries and regions, and combined with specific problems of legal provisions about disciplinary power in our country, maybe can give some recommendations on the reconstruction of our disciplinary power legal system.
