Research The Chinese Family Law In Multiangles

The Chinese legal system is recognized as one of the world's five legal systems, while the Chinese legal system's one significant feature is paying attention to the consanguinity and family feelings,Protecting the patriarchal tsunatsune.From this point,the Chinese legal system can be called "Patriarchal Law".If the Chinese legal system is mainly recognised as state law,there is a family law in the society Correspondly in a long time.Maybe the family law psy a more important sole in the society than the national law.Therefore,family law is more and more valued by chinese and foreign scholars.This article tries to explain the paths of chinese familiy law upon esisting researches.Firstly, I will study the origin of the chinese family law dynamically,so that we can understand the strong vitality of the chinese family law. Secondly,I put the chinese family law under a macro history condition,studying its necessity and processity.Thirdly,I will analyse the content of chinese family law which is mainly the matter about the upper period of chinese family law in ancient history,so that we can realize the family law's nonreplaceable function. Fourthly,I will discuss the character of the chinese family law,in this article,the chinese family law's content is abundant,its function is complete,its action is very important,it has diversities,we can not only see its one bit,we should not look it as a single law.Fifthly,I want to judge its signification,we must to affirm its necessity ,rationality and positivity ,in the meantime,we should not denial its neqativity.The five areas are the main part of this article, simultaneitily,they are five ways to study the chinese family law,I will separately expound different problems about the family law,I try to give a clear and comprehensive acquaintance about the chinese family law,which maybe to be help to make a equitable judge about it.
