| Labor dispatch as a new form of employment has been rapidly developing in China in recent years. Labor dispatch separates using from employing,the labors have two employers who have different function. This complex triangular relation makes it difficult to locate their responsibilities. Although it is regulated for this employment model in"The Labor Contract Law of People's Republic of China",it is too general to separate the two sides'responsibilities.This triggered a lot of labor disputes.In order to distribute the rights, responsibilities, benefits of the three side, and implement employers'liability for the workers.It is very necessary and urgent to study the distribution system of employers'liability in labor dispatch.This article,divided into four parts,deals with the distribution of employers'liability in labor dispatch. Part one: analyse the basic theory of the distribution of employers'liability in labor dispatch. First,analyse the concept of labor dispatch and the concept employers'liability,clarify the content of employers'liability in labor dispatch. Second, clarify the legal relationship between the three main structure.Part two: analyse the defects of the distribution of employers'liability in chinese labor dispatch, based on current legislation in our country.Part three: analyse the distribution of employers'liability in labor dispatch in the world's major industrialized countries,put forward useful suggestinon for chinese labor dispatch. Part four: Aimed at the problems of the distribution of employers'liability in chinese labor dispatch, put forward some measures to improve the distribution of employers'liability in chinese labor dispatch. |
