In recent years, the labor dispatch has developed very fast in China, and the relevant regulations had been published by each place to regulate it. The Labor Contract formally implemented in Jan 1st, 2008, uses one section to regulate the relevant questions of the labor dispatch, but there is much gap among the relevant laws, the status quo of obtaining employment of our country's labor force and the flourishing development of the labor dispatch. The labor dispatch should be the non-mainstream fashion of obtaining employment, but vice versa in China. It impacts strongly on the traditional mainstream fashion of obtaining employment and triggers a series of social problems.How do we regulate this novelty effectively to make it show its advantage and avoid the weak, and construct the harmonious socialism labor relations. We must make clear the real features of the labor dispatch at first. This article starts from the status quo of the development of the labor dispatch at present in China, connecting with the present laws and brings up the relevant perfect legislation suggestions.All in all, the legislation of our country's labor dispatch shall not borrow or transplant the relevant legislation of the developed country of market economy, and shall base on our socialism country's nature, and shall be established on the status quo of our country's labor force,and regulate the employers'liability to keep the legal rights of the great dispatched labors who lie in the disadvantaged status. Not only protect the relevant rights of the labor force, but what's more perfect the right relief measures of the labor force.
