Research On The Phenomenon Of Jailhouse Bully

The rights of detainees in detention centers seems insignificant at all in a nation known for a long history of ignorance of human rights. However, to protect and respect rights of detainees is the requirements of law, especially the requirements of progress of civilization and social harmony. Actually, concern and protection for the rights of detainees is also for our own. This paper analyzes the reason why jailhouse bullies exist in detention center: the author selects the utilitarian basis of jailhouse bullies as the starting point, makes in-depth analysis, psychological factors of jailhouse bullies will be elaborated and analyzed, and strikes a conclusion that we should attribute the phenomenon of jailhouse bullies to institutional reasons. The detention system level has been a limit to the level of protection for human rights throughout and now is becoming an insurmountable obstacle placed on the way to thoroughly solve the problem of jailhouse bullies. Detention system involves custody system, management system, various management regulations, monitoring system and so on. the author argues on how to standardize and improve the existing detention system: to take presumption of innocence as the guideline, further improve the relevant legislation, reform the management system, complement the monitoring system, custody system and management regulations.
