accusations of illegal medical practice and medical negligence have been added into the newly revised Criminal Law. But the Practicing Physician Law which has been enforced on May 1st of 1999 and Regulations on Administration to Country Doctor which has been enforced on January 1st of 2004 are quite different from each other on the regulations of the trade permission. The conditions for the trade permission of country doctor is not as strict as that of practicing doctor. Then the issue aroused by this situation is that when country doctor cause the death of the patient in his medical practice, the condition of the subject has its characteristics while applying the concrete accusation. Hence a study focusing on the construction of the relevant suspected crimes, especially the issue of subject and the objective circumstance from the perspective of the practicing requirements of the country doctors possesses a highly practical significance. This thesis, based on a case of suspected illegal medical practice, carries on a concrete analysis on whether the act of the criminal suspect constitutes the crime of illegal medical practice, the crime of negligent homicide or the crime of medical accident. And by studying the issue on the suspected crime of the country doctors in their medical practice, the thesis tries to make some modest contribution to the judicial practice.
