Reviewing in recent years, many serious traffic accidents are caused by drunk driving, these accidents are bloody lessons, while they damage the safety of life and property of the people, and also receive extensive attention of the whole society. Two similar traffic accidents, the decision of the court were very different, as the traffic offence and crimes against the public in a dangerous way,which caused the query of public, and the dispute of legal circles. This article introduces the Weiming Sun drunk driving basic case and Henan drunkenness BMW's case, then analyses and discusses the conviction controversy of the drunk driving behavior. The legislation about the drunk driving is not perfect in our country, so there are many problems in dealing with cases of drunk driving, which should be taken examples by the advanced experience of other countries on the basis of legislation to consummate. At the same time the author thinks that the stringent control of drunk driving is necessary, the eighth amendment of criminal law will solve this problem, the conviction of drunk driving will protect our safety on road.
