Remedies of the civil service, civil servants to realize the legitimate rights of the powerful security, the protection of civil rights, improving government work style, the rule by laws of great significance. To truly protect the rights of civil servants, some foreign countries have the rule of law established a relatively complete system of civil servants the right to judicial relief, but due to "special power relations" theory as well as the impact of unfavorable factors, none of our long established Civil Justice relief system, but the current situation, China has possessed the right to judicial relief to establish the appropriate civil service conditions: First, to support the establishment of the Civil Rights of the theoretical basis of judicial relief system has become more sophisticated. Second, the right to judicial relief of foreign civil servants to our successful practice to provide a useful reference. Third, raise the Rule of Law and Civil Rights groups, enhanced awareness of the right to judicial relief for the Civil Service System in providing the social conditions. In these favorable factors, the Construction of the civil service system is undoubtedly the right to judicial relief is feasible. At present, we should fully understand the legal rights to establish civil service system of the importance of judicial relief under the premise, by changing the traditional concept of a clear civil rights principles of judicial relief, expanding the scope of the case by the Administrative Procedure Law, expand judicial relief space, to learn foreign civil servants experience of judicial relief, the establishment of judicial review, etc. to improve our civil rights remedy system in order to protect the legitimate rights and interests of the civil service groups.
