A Probe Into The Right Relief System Of Civil Servants In China

The civil service system is an important part of our country’s current administrative legal system.It ensures the correct implementation of national policies,standards,laws and regulations so that civil servants can perform their work in accordance with the law in various positions after being assessed and appointed,and are not infringed on their rights to ensure that the society stable.Among the civil servants in my country,many are ordinary workers who are unknown.They perform public duties on behalf of the country and occupy a place in the administration of the country.However,due to the constraints of the system and some deep-rooted traditional ideas,many civil servants are timid and afraid to protect their rights through legal means when they are violated.Even if they are protected by some means,they have little effect.This situation often severely weakens the enthusiasm of some civil servants.In order to enable civil servants to do their jobs in accordance with the law,they need to protect the rights of civil servants.Therefore,the relief and protection of their rights is crucial and this problem has caused many scholars to respond accordingly.Pay attention.With the promulgation and implementation of a series of related laws and regulations such as the "Civil Servants Law",my country’s civil servants’ rights relief system has preliminary regulations.But at present,there are still some problems in our country’s civil servant rights relief system.In this regard,this article first starts from the concept of defining the civil servant’s rights relief system,expounds what is a civil servant and what is a civil servant’s rights relief system,and explores the three unique principles of civil servants’ rights relief,namely the principle of due process and administrative internal relief.The prerequisite principle,the final judicial relief principle,and the related theories of the right relief system are introduced to lay a good theoretical foundation for the following research.On this basis,the article expounds the current situation of the civil servants’rights relief system in China,and summarizes the current situation in China.There are several basic types and characteristics of civil servants’ rights relief;secondly,through the previous research,the problems of the current civil servants’ rights relief system in our country are analyzed in detail,that is,civil servants have weak awareness of the rule of law,related rights relief legislation is not perfect,and the relief system lacks strict procedures.,Its related relief agencies lack independence and credibility and lack of judicial relief.Then the article expounds the civil servant rights relief system of several typical developed countries in Britain,the United States,and Japan,analyzes its measures in administrative relief and judicial relief,and derives some useful experience;thus further clarify and improve our country.The specific countermeasures for the construction of the civil servants’ rights relief system are to enhance the civil servants’ rights awareness,improve relevant legislation,improve specific relief procedures,establish an independent civil servants’ rights relief agency and introduce judicial relief to strengthen the system.
