On The Restriction Of Freedom Of Expression

As a basic human right and important quality, the freedom of expression has been increasingly concerned about. The freedom of expression has important significance for one's development ,social progress and national harmony. It is also an inevitable problem in our social and legal construction. With the demarcation is constantly deepened, the living space of the freedom of expression has been continuously widened. Therefore, the opposition of protection and restriction has been promoted to point of the new history.The thesis is to reveal the important role infinite glamour of the freedom of expression from the starting point of its ideological evolvement, connotation, constitutional rights and three dimensional values to a person, society and country. However, the execution of any right and freedom has its limits. The second part of the thesis demonstrates the necessity to the restriction of the freedom of expression. Finally, on the basic of the previous theories and practices, the principles of the restriction of the freedom of expression have been put forward. They are such as follows: Carry out different restrictive principles for public speaking and private speaking. The restrictive principles between private speaking and public conflicts and between private speaking and private conflicts are not always the same. Though using the different restrictive principles and weighing standards, the purpose attained finally is unique, that is, restriction is to give better protection.
