Chinese people pay a heavy price for it ,because of traditiona law's faultiness. Even though, decades's years after liberation, the law can not be paid much attentation to. Under the guidance of the theory of Deng xiaoping in building socialism with Chinese characteristics, which made by CCP's the Third Plenary Session of the Eleventh Central Committee , in 1966 the peopele's congress made the policy : State affairs according to law, the construction of the socialist country ruled by law. As a socialist harmonious society advanced, the morality and legal issue catch much attentation from all circles. For a long time, we havn't kept a watchful eyes on the importance of investigation into legal rule and maoral rule. We take legal way to deal with the issue without thinking about rule of virtue, not leading to the expective result. For that reson, the author desirsed to prsent the theme:the moral legalization, to urge the morality to be legalized and drive the Chinese rule of law and virtue to be put into effect.Moral legalization is general phenomenon of social development. China's socialist market economy is gradually established and perfect, which help the legal situation to be set up. In ten years we got experience , lessons and accumulation of problems .With economic development and ideological and political education, many conflicts have been defused in the society. But there are still many conflicts existing. it can be solved by the rule of law, which is affected by normal and sysmetic legal rule. The rule of law plays a very important role in the construction of the socialism market economy, which can solve many social conflicts reasonably and effectively and is the key to keep all the works developing. Because of the legal influence, the nation take the rule of law as the policy. It was accepted by broad cadre and masses quickly. However, China is in the primary stage, it is necessary to strengthen the socialist legal system construction,. Meanwhile, to reinforce the construction socialist ethic is an impotant task and reflection of he socialist legal system construction. In history each type of society has its moral culture. They not only enhanced the constuction of legal system, but emphasized their own moral construction. Socialist society is advanced social form. It is sure to need the moral civilization. China take the economic construction as the central task since the CCP's the Third Plenary Session of the Eleventh Central Committee, at the same time, the comrade Deng Xiaoping proposed that our country ,on one hand ,should Grasp the construction of material civilization, on the other hand grasp the construction of spiritual civilization. Chinese socialist modernization has gained the great success that attract worldwide attention, but many problems of moral and ethics, party style and government ethics are needed to be settled, especially during the system transforms. It is the demand of era to realize the moral legalization and the only way of ethics and legal development. Both of the rule of law and birtue are interpenetrative and have the close relation. China's socialist economic foundation determines superstructure. It is necessary to combine the two aspects together. The realization of heteronomy, stiffness and ethics need the force of public opinion. Moral legalization can harmonize all kinds of social function and achieve the social stability and development. Theoretically, the inside balance makes the moral legalization possible. the moral legalization is inevitable. We can realize the moral legalization by series ways of enforcing moral Legislation, system and ethics construction, moral education and building legal institutions.Nevertheless, there are difference between ethics and law, which lead moral Legislation to be implemented in rational limitation.All in all, moral legalization is to run the country with morality, to coordinate and balance program development of ethics and law and to provide theory support for implementation of "Rule by Law" and "Rule by Virtue ".
