Issues On Computer Crime

The development of computer network greatly promotes the process of human civilization. It makes our social life richer, and become productivity for creating wealth. Computer crime is a new type of crimes; it appears along the popularity of the internet. In the virtual net world, criminals could use all the method to do net crime like high intelligence,low risk and difficult to control. Above all, strengthen the basic research for the theory of this kind of crime becomes a very urgent problem in the application of computer. So, we should continue perfect laws against computer crime, shock all the crime desire of criminals, punish all the net criminals, blow crimes strictly, reduce net crime happening, pure and perfect the environment of internet, to ensure the area of computer network lasting peace and stability in our country.This paper try to put forward the ideas to preventing computer crime, from the current characteristics of computer crime,research direction,detection technology,theories on electronic evidence and against strategy of preventing, combined with current criminal law and judicial practice.The first part concludes and analyzes the status of computer crime. The second part confines computer crime and characteristics, guiding ideology and directions. It points out that computer crime is a behavior which should be punished because breaking criminal law using computer skill and knowledge. The third part is the performance of computer crimes set in criminal law in our country. The fourth part is the defects existing in the legislation about computer crime in criminal law in our country. The fifth part is about the revising in judicial practice problems on computer crime. And the last part is prevention and against strategy of computer crime.
