There is no explicit stipulation whether synchronous sound or image recoding can be regarded as evidence or which kind of evidence it is in Criminal Law in our country. At present, various kinds of perspectives about synchronous sound or image recording are appeared in theory circle, such as"Audio Visual Materials Theory","Physical Evidence Theory","Documentary Theory","Compound Evidence Theory", and"Independent Evidence Theory"and so on. It is extremely necessary to define synchronous sound or image recording, for its directness with the legality of criminal suits. The non-stipulated problem should be studied, searched and explained, thus eliminating"Systematic Illegality"and perfectly completing the value of law. Though synchronous sound or image recording has the nature of evidence, yet it is difficult to classify it into one of the seven exiting kinds of evidence. The synchronous sound or image recording should be regarded as an independent kind of evidence, but under the existing legal circumstances, it can only be regarded as audio and visual materials.
