Marital rape is defined as a kind of the compulsory sexual behavior which is forced by the husband without the agreement of his wife by using violence, intimidation and other means during the marriage. The phenomenon of marital rape existed since ancient times, however, it was not recognized as crime, because the status of women was very low under the male-supremacy system, and they had not the independent personality, even more the rights in sexual activities. With the rise of the feminist movement, more and more people pay attention to the marital rape gradually for the women's awareness of right protection in modern society. At present, the criminal law theory on marital rape to different attitudes, and it makes the female victims of marital rape can not be fully protected. Therefore, this article analyzes the phenomenon of marital rape and how to protect the rights of female victims from the perspective of civil law to look forward to finding out a new way to solve the issue of marital rape.
