Duty Crime Preliminary Investigation

China is now in the new era of upholding economic construction as the central task, deepening reform, extending the scope of opening to the outside world and establishing a socialist market economic system. Persistently and resolutely combatting corruption is a very significant strategic measure. As legislation and relevant judicial interpretations of the initial investigation is not clear, the understanding and application of initial investigation is obscure and unstandardized in the investigation department.This thesis investigated the formation, necessity, status quo, legal basis, characters, orientation and improvement of initial investigation of the crime by taking advantage of duties. The imperfection legislation and unstandardized practices of initial investigation were solved by clearing the definition of the initial investigation of the crime by taking advantage of duties, summarizing the means of initial investigation of the crime by taking advantage if duties, comparing to domestic and international research and proposing the monitoring measure. Consequently, initial investigation which is the most basic and the first, as well the weaker part of investigation the crime by taking advantage of duties is strengthened. Then it improves and deepens the investigation of the crime by taking advantage of duties effectively.
