The Light Injury Cases Dealing With The Judicial Status And Legal Countermeasures

Light injury cases in criminal cases have a higher proportion of a class of cases, such cases because of multiple in the neighbourhood, between the relatives and friends, processing is undeserved easy to cause conflicts, even will cause tired of first instance, visit wrapped or leapfrog petition, affect social stability. Proper handling of minor criminal cases, for improving the quality of criminal cases, better build a harmonious society, has the important practical significance. This article is from this perspective, the light injury cases dealing with this subject puts forward some reasonable suggestions.The first part of 1979, according to criminal law and criminal law on light damage in sentencing of change, point out our country against light injury cases treated seriously, and to our country light injury cases are defined and their characteristics are summarized, that deal with light injury case for the importance of building a harmonious society.The second part, analysis of the current processing of light injury cases, judicial status, including light injury case processing procedure defects, trial procedure problems, minor cases treatment is insufficient, and points out that these problems on treatment of light injury cases, disadvantage, both neither accords with current both-strict-and-lenient criminal justice policy, also do not accord with the current criminal procedure law.The third part, the author draws on current light injury cases treated in the foundation, unifies our country national condition, put out the light injury case processing to reconciliation into the legal procedures, establish relevant processing mechanism, the judicial organ to form a cohesive force and other measures for reference.
