A Study Of The Students' Discipline And Punishment System In Our Country's Universities

The students'disciplinary system of China's college is an important aspect of students'management. Recently, more and more administrative cases of higher education arise throughout our country. The litigation is concentrated on the problem of violating rules and principles of the college. On one hand, it manifests the enhancing legal awareness of students; on the other hand, it also reflects some problems existing in our country's university students'disciplinary system. To perfect the current disciplinary system and improve the relief channel in and out of campus is not only the requirement of protecting students'legitimate rights, but also the requirement of promoting the legal construction of higher schools.This text is divided into four parts. The first part discusses higher schools'legal status, legal relationship between universities and students, legal validity of college disciplinary regulations and legal nature of the rights of the universities. It provides the theoretic basis of exploring the disciplinary system. The second part analyzes the college students' disciplinary system of foreign countries. It takes Stanford University and Oxford University as examples to study American and British university students'disciplinary system, and provides beneficial reference for the perfection of our disciplinary. The third part presents the situation, problems and difficulties of our country's university students' disciplinary system----the boundary of college discipline system is vague, the disciplinary regulations are lack of standardization and the students'right relief system is not complete. The last part puts forward the methods of perfecting the system, such as identifying the boundary of college discipline system, constructing proper procedure system and the public hearing system, and improving the approaches of students'rights relief.
