Research On The Relations Between University Students' Administration System And Students' Rights

Since reform and opening up, China has formed a basic framework of the legal system of education and regulated the rights and duties of the legal relationship between the main parties. A good legal environment is taking shape, but under the influence of social relations' profound changes which triggered by the sustained, in-depth social transformation, the disputes of college and students are increasing, and the legal relations are also facing severe challenges.In China, the status of public colleges and universities are special, on the one hand, it resembles other ordinary entities which is a legal person set up in accordance with the law, enjoys civil rights and meets civil liabilities. On the other hand, it is authorized by laws and regulations, exercises the power within the authorized jurisdiction and bears the duty. In addition, according to the rules of the existing system, it also bears certain obligations of social management.The management of universities mainly means the decision-making power of the school, it is the unique basic power of the universities, and is also the universities to be the educational legal relationship entity's premise. It mainly means that the universities have the qualification and capability to realize its' educational tenet, to do its' didactical management, to realize teaching activities. In order to protect students' rights of being educated, supply a good educational environment, the universities combine their own conditions to establish the inner student's management system. However, the universities student's management system leads to legal affairs between students and universities flat.In the legal process, the universities student's management system has flaws and mistakes, it appears in six aspects: the content of college student management system conflicting with the laws and rules, the universities beyond their management jurisdiction, the universities student management system having flaws, the universities student management system confusing and being ambiguous, which can lead to inaccurate for the students of the characterization, college students in the management practices of the legal right to education being not a sound way to relief. This paper also analyzed reasons and solutions of the problems, and made positive recommendations to the establishment and improvement of the students' rights protection mechanism.
