Study On The Law Applicable To International Products Liability

With further development of the international economy and technology, the cases of international products liability increase day by day. At present, the law applicable on Products Liability is adopting the rule of place of tort in China, neglecting the more osculation and important factors. While in entity law, the existing laws and regulations have not legislation on international products liability. In order to satisfy the actual demand of international economy, it should legislate perfectly according the existing rules and experience.The first chapter of this thesis in order to interpret the conflict of laws on Products Liability,the thesis compares the concepts in main countries in the world of law on Products Liability,such as'Product,defects , person , the principles of Products Liability, and damage compensation'.The second chapter of this thesis is to find the solutions from conflict applicable on international products liability. Besides the traditional theories, it focuses on the latest development trend of law applicable to international Products Liability.The third chapter of this thesis is to find the solutions from convention and entity laws on international products liability. It shares the experience from the content of'Convention on the Law Applicable to Products Liability'and'Regulation on the Law Applicable to Non-Contractual Obligations'. Although it is much difficult to realize globe legislation of entity laws, the Europe has made great achievement, such as'The European Convention on Products Liability in Regard to Personal Injury and Death'and'European Economic Community on Products Liability'. Among European countries, Germany reveals the advanced assimilation and development.The last chapter of this thesis analyzes the current legislation on international products liability in China from conflict applicable and entity laws. In the end of thesis, I put forward my own suggestions on how to make progress on Chinese legislation and reach perfection.
