| Since the Reform and Opening-up policy, China's economy has been developing rapidly. A large number of companies have been set up.On December 29, 1993, the Standing Committee of the National People's Congress passed the Corporations Law of the People's Republic of China. This law has played a crucial role in the normalization and healthy development of corporations, thus greatly promoting the economic growth of our country.However, some people have abused the new law. They have set up all kinds of fly-by-night companies to acquire illicit monetary benefits and thus severely damaged the rights and interests of the state and common people. In judicial practice, falsely reporting registered capital is a common crime. Because of the lack of a proper understanding of this type of criminal activities and the relevant law, the judicial system often mishandles these cases.This paper analyzes a real case and endeavors to systematically study the crime of falsely reporting registered capital. It will describe the regularities and patterns of this crime, supplying theoretical support for the fair and proper enforcement of the law in this regard. |
