Abstract/Summary:
Remuneration for labor rights is a basic human rights of citizens and property rights, our government has always been a high degree of protection. Especially into the twenty-first century, with the rapid economic growth, scientific development concept, put forward the building of a harmonious society and human rights into the Constitution, the rights of China's legal protection of labor remuneration push up a new height. The face of socio-economic development and national policy requirements, the current payment for labor rights protection gap between reality and needs widening, call the times, the state has increased the reward for labor rights protection, the development of the "Labor Contract Law" and refused to pay remuneration for the act provides for the crime of refusing to pay the remuneration.In this paper, refused to pay remuneration for the punishment into perspective, analysis of the remuneration of the right content, the historical background of the crime, analysis of this crime to be established the legal basis for refusing to pay the remuneration that acts against the state's right to remuneration protection system, induce a series of unstable disharmony of social problems, and contribute to social remuneration to reflect the absence of legal protection of the right to refuse to pay remuneration to curb the impact. The legislature conforms to the historical and public opinion, refused to pay additional remuneration crime, pay the state to protect labor rights, especially rights of vulnerable migrant workers compensation, punishment refused to pay remuneration, have a more complete legal system. We should also be correctly recognized that the State should continue to focus on governance.
